Terms of Service

These Terms govern your use of CMass — the Gmail mail merge and outreach tool. Please read them. The short version: use CMass responsibly, comply with email laws, and don't spam people.
1. Acceptance of terms
By installing the CMass Chrome extension or using any CMass web service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use CMass. These Terms constitute a binding agreement between you and CMass ("we", "us", or "our").
2. Description of service
CMass provides a Gmail mail merge and email outreach tool delivered as a Chrome browser extension. Features include importing contacts from Google Sheets and CSV files, sending personalized mass emails via your Gmail account, AI-powered email personalization using Anthropic's Claude, automated follow-up sequences, and campaign analytics including open and click tracking.
3. Eligibility
You must be at least 18 years old to use CMass. By using CMass you represent that you are 18 or older and have the legal capacity to enter into this agreement. CMass is intended for business and professional use.
4. Account and access
- Google account:CMass requires you to connect a Google account via OAuth. You are responsible for all activity that occurs under your connected Google account.
- Account security:You are responsible for keeping your CMass credentials secure. Notify us immediately at legal@cmass.io if you suspect unauthorized access.
- Accurate information:You agree to provide accurate information when signing up and to keep it current.
5. Acceptable use
You agree to use CMass only for lawful purposes. You may not use CMass to:
- Spam:Send unsolicited commercial email (spam) in violation of CAN-SPAM, GDPR, CASL, or any applicable law.
- Harassment:Send harassing, threatening, defamatory, or abusive messages.
- Deception:Send emails with false headers, misleading subject lines, or impersonate another person or organization.
- Malware:Send emails containing malware, viruses, or malicious links.
- Illegal content:Send content that violates any applicable law, regulation, or third-party rights.
- Abuse of AI:Use AI personalization to generate discriminatory, hateful, or fraudulent content.
- API abuse:Exceed Gmail API quotas, circumvent rate limits, or take actions that could result in Google suspending your account.
6. Email compliance
You are solely responsible for ensuring your email campaigns comply with all applicable laws, including:
- CAN-SPAM Act:Every commercial email must include a valid physical postal address, an honest subject line, and a clear opt-out mechanism. CMass includes a one-click unsubscribe link in every campaign automatically.
- GDPR:If you send to recipients in the European Union, you must have a lawful basis for processing their personal data (e.g., legitimate interest or consent). You are the data controller; CMass is the data processor.
- CASL:If you send to recipients in Canada, you must have express or implied consent.
- Unsubscribes:You must honor unsubscribe requests. CMass automatically suppresses unsubscribers but you are ultimately responsible for compliance.
7. AI personalization
CMass uses Anthropic's Claude AI to generate personalized email content. By enabling AI personalization you acknowledge that: (a) AI-generated content may occasionally be inaccurate or inappropriate — you are responsible for reviewing content before sending; (b) recipient data is transmitted to Anthropic's API in accordance with Anthropic's usage policies; (c) CMass does not guarantee any specific open or reply rates from AI-generated content.
8. Gmail API and Google terms
CMass operates under Google's API Terms of Service. Your use of CMass must also comply with Google's Acceptable Use Policy. You acknowledge that Google may revoke CMass's API access or your account access at any time in accordance with their policies. CMass is not affiliated with or endorsed by Google.
9. Subscription and payment
- Plans:CMass offers free and paid subscription plans. Paid plans are billed monthly or annually as selected at signup.
- Trials:Paid plans include a 7-day free trial. You will not be charged until the trial ends. Cancel before the trial ends to avoid charges.
- Refunds:We offer a 7-day money-back guarantee on your first paid month. Contact legal@cmass.io within 7 days of your first charge.
- Cancellation:You may cancel your subscription at any time. Your access continues until the end of the current billing period.
- Price changes:We will notify you at least 30 days before any price increase.
10. Daily send limits
CMass enforces daily email send limits per plan (50/day on Free, 500/day on Pro, 2,000/day on Team). These limits exist to protect deliverability and comply with Gmail API quotas. CMass is not liable for emails not delivered due to Gmail quotas, bounce rates, or spam filtering.
11. Intellectual property
CMass and its associated software, design, and content are owned by us and protected by copyright and other intellectual property laws. You may not copy, reverse-engineer, or create derivative works of CMass without our written permission. You retain ownership of all content you create and send through CMass.
12. Termination
We may suspend or terminate your access to CMass immediately if you violate these Terms, engage in email abuse, or if required to do so by law. You may terminate your account at any time by contacting legal@cmass.io. Upon termination, your data will be deleted within 30 days.
13. Disclaimers
CMass is provided "as is" without warranties of any kind, express or implied. We do not warrant that CMass will be uninterrupted, error-free, or that emails sent through CMass will be delivered. We do not guarantee any specific results from your campaigns.
14. Limitation of liability
To the maximum extent permitted by law, CMass's total liability to you for any claim arising from these Terms or your use of CMass shall not exceed the amount you paid to CMass in the 12 months preceding the claim. We are not liable for any indirect, incidental, consequential, or punitive damages.
15. Indemnification
You agree to indemnify and hold CMass harmless from any claims, damages, or expenses (including legal fees) arising from your use of CMass, your violation of these Terms, your violation of any applicable law, or your email campaigns.
16. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of San Francisco County, California.
17. Changes to terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on cmass.io at least 14 days before the changes take effect. Continued use of CMass after the effective date constitutes acceptance.
